Terms and Conditions of NCC Service – TOPO MARIO

1. Booking and Payment

Bookings can be made by phone, email, or through our website.

Payment may be made by credit card, bank transfer, Satispay, or cash. Payment can be made in advance or at the end of the service; for further details, please refer to section 2.4 of these Terms and Conditions.

Once the booking is confirmed, you will receive a confirmation email or message with all service details.

2. Changes and Cancellations

Any changes to bookings must be communicated at least 24 hours before the scheduled service time.

Cancellations made at least 24 hours in advance and less than 48 hours before the service will be refunded at 50%.

For cancellations made less than 24 hours before the service, the full service cost will be charged.

Services requested by private individuals are guaranteed only if paid in advance.

3. Driver and Vehicle Changes

TOPO MARIO reserves the right to change the assigned driver and/or the booked vehicle type based on availability and operational needs. Any replacement will be made with personnel and vehicles of equal or higher quality.

If a lower-category vehicle than the one booked is provided, a 10% price reduction will be applied.

4. Punctuality

TOPO MARIO undertakes to respect the agreed schedules. However, we are not responsible for delays caused by force majeure (e.g. traffic, adverse weather conditions, road accidents).

TOPO MARIO is not responsible for missed connections with other means of transport (flights, trains, etc.) due to force majeure.

5. Onboard Conduct

Respectful and appropriate behavior is required during the journey. In the event of inappropriate or safety-risk behavior for passengers and/or the driver, please refer to section 6 of these Terms and Conditions.

Smoking and consumption of alcoholic beverages are prohibited onboard our vehicles.

Eating onboard our vehicles is strictly prohibited.

Passengers are responsible for any damage caused to the vehicle during the service.

6. Service Interruption, Safety Conditions, and Inappropriate Behavior

TOPO MARIO reserves the right to interrupt the service at any time if safety conditions for the driver or passengers are no longer met.

“Safety conditions” refer to any circumstance in which the physical safety of the driver, passengers, or third parties may be at risk. These conditions include, but are not limited to:

  • Threatening or violent behavior: Any physical or verbal behavior that may be considered threatening, intimidating, or dangerous to the driver or passengers.

  • Driver incapacity: Conditions that prevent the driver from safely operating the vehicle, such as sudden illness, extreme fatigue, or other medical emergencies.

  • Vehicle malfunctions: Mechanical or electronic issues that may compromise safety during the journey.

  • Hazardous external conditions: External situations such as extreme weather (snow, ice, storms), natural disasters, or road accidents that make it unsafe to continue the journey.

  • Use of alcohol or drugs: If the client is under the influence of alcohol or drugs to a degree that compromises travel safety or the well-being of other passengers.

Lack of Appropriate Conduct refers to behavior that does not comply with the rules of conduct required during NCC services. This includes, but is not limited to:

  • Verbal or physical aggression: Any form of verbal or physical abuse toward the driver, other passengers, or third parties during the service.

  • Intentional damage: Deliberate actions causing damage to the vehicle, its equipment, or other property during the journey.

  • Refusal to follow driver instructions: Failure to comply with the driver’s instructions, especially those related to safety (e.g. refusal to wear a seatbelt or to exit the vehicle when requested).

  • Disruptive behavior: Behavior that seriously disturbs other passengers, such as shouting, excessive noise, or actions that make the journey unpleasant or unsafe.

  • Consumption of prohibited substances: Consumption of alcohol, drugs, or other prohibited substances inside the vehicle.

7. Liability

TOPO MARIO is not responsible for any items lost or left onboard the vehicles. Lost items will be handed over to the nearest local police station or may be collected at our premises if expressly requested by the client.

8. Safety

All our vehicles are regularly maintained and comply with the safety standards required by law.

The use of seat belts is mandatory for all passengers during the journey.

Vehicles are equipped with video and audio recording devices. The collected data are retained by the service provider and processed in compliance with applicable privacy regulations.

9. Waiting Policy

Free Waiting Time: For all NCC services provided by TOPO MARIO, a free waiting period of 15 minutes is granted starting from the agreed booking time or from the vehicle’s arrival at the pickup point specified by the client.

Waiting Fee: After the 15 minutes of free waiting time, a waiting fee of €50 per hour will be applied, calculated in 30-minute increments. Each half hour of waiting, or fraction thereof, will result in a charge of €25.

Start of Waiting Time Calculation: Waiting time calculation begins after the 15 minutes of free waiting. For example, if the client is 20 minutes late compared to the agreed time, a waiting charge of €25 will be applied (corresponding to the first 30 minutes of paid waiting).

Delay Notification: It is the client’s responsibility to promptly inform TOPO MARIO in case of delays. If the delay is not communicated and exceeds 30 minutes from the scheduled time, the driver reserves the right to consider the service canceled, applying the cancellation conditions specified in section 2, Changes and Cancellations.

Special Conditions: In specific situations (e.g. delays due to flights or trains), a different waiting policy may be agreed upon in advance between the client and TOPO MARIO.

9. Privacy

Personal data collected during the booking process will be processed in accordance with applicable privacy regulations and will not be shared with third parties without the client’s consent.

10. Acceptance of Terms

By making a booking with TOPO MARIO, the client accepts the above terms and conditions.
